Manitoba’s New Workplace Menstrual Product Requirements: What Businesses Need to Know

Starting September 1, 2026, new workplace regulations in Manitoba will require provincially regulated employers to provide free menstrual hygiene products for employees. The changes are designed to improve workplace accessibility, hygiene, and employee wellbeing across the province.

For many businesses, this will mean updating washrooms, adding disposal containers, and ensuring menstrual products are available in a practical and accessible way.

Why These Changes Matter

Menstrual hygiene products are essential workplace necessities, just like soap, toilet paper, and paper towels. However, many employees have traditionally been expected to bring and pay for these products themselves.

The new Manitoba regulations aim to create a more inclusive and supportive workplace environment by making menstrual care products available at work without cost to employees.

This change also helps reduce situations where employees may face discomfort, stress, or embarrassment due to lack of access to menstrual products during working hours.

What Manitoba Employers Will Be Required to Provide

Under the new regulations, employers must ensure employees have access to:

  • At least one type of menstrual pad
  • At least one type of tampon
  • A covered menstrual disposal container near every employee toilet

These products must be accessible in:

  • Women’s washrooms
  • Men’s washrooms
  • Gender-inclusive washrooms

The goal is to ensure products are available to all employees who may need them.

Are Product Dispensers Mandatory?

No. Manitoba’s regulations do not require employers to install dispensers.

Businesses may choose simple countertop baskets, wall-mounted units, cabinets, or other accessible storage methods depending on their facility layout and operational needs.

However, products must remain easy for employees to access and available during all working hours.

Alternative Placement Options

In certain workplaces, placing products directly inside washrooms may not be practical. For example:

  • Very small washrooms
  • Shared public/customer washrooms
  • Limited wall or counter space

In these cases, employers may provide products in another nearby location if:

  • Employees can access them at all times
  • Privacy is reasonably maintained
  • Products remain available even if washrooms are temporarily closed

Examples may include:

  • Staff supply rooms
  • Janitorial closets with employee access
  • Employee wellness stations

When Do These Rules Take Effect?

The regulations officially come into force on:

September 1, 2026

Manitoba has also provided a transition period to allow businesses time to prepare by:

  • Ordering menstrual products
  • Installing disposal containers
  • Reviewing washroom layouts
  • Training staff or updating workplace policies

Which Businesses Are Affected?

The regulations apply to provincially regulated workplaces in Manitoba, including many:

  • Retail stores
  • Restaurants
  • Warehouses
  • Manufacturing facilities
  • Offices
  • Service businesses
  • Local contractors
  • Hospitality businesses

Prime contractors are also included under these requirements.

Federally regulated businesses may already fall under separate federal requirements introduced earlier.

Estimated Costs for Employers

According to Manitoba government estimates:

  • Annual product costs may range approximately from $10–$25 per employee who menstruates
  • Initial equipment costs for disposal containers or storage solutions may range from roughly $20–$300 depending on the setup selected

Actual costs will vary based on:

  • Workplace size
  • Number of employees
  • Washroom count
  • Product quality and usage levels

Penalties for Non-Compliance

These requirements will be enforced under Manitoba’s Workplace Safety and Health legislation.

Businesses that fail to comply may face penalties and fines ranging from approximately:

  • $1,000 to $5,000

Maintaining compliance will become part of overall workplace hygiene and safety responsibilities.

Preparing Your Workplace Early

Businesses are encouraged to begin planning ahead before the September 2026 deadline by:

  • Reviewing current washroom setups
  • Determining suitable product placement areas
  • Selecting disposal containers
  • Estimating monthly product usage
  • Working with janitorial and sanitation suppliers for reliable inventory

Early preparation can help avoid last-minute costs and ensure a smooth transition once the regulations become active.
